The primary legal issues considered were whether the plaintiffs should pay the defendants’ costs of the plaintiff’s on the indemnity basis pursuant to rr 681 and 702 of the Uniform Civil Procedure Rules 1999 (Qld) (‘UCPR’), whether the first and second plaintiffs should pay for the defendant’s costs of the counterclaim on the indemnity basis pursuant to rr 360 and 703 of the UCPR, and whether the plaintiffs should pay the defendants costs of and incidental to the dispute over the form of final orders on the standard basis, pursuant to r 681 of the UCPR.
The court made orders for the plaintiff to pay the defendants’ costs of the plaintiff’s claim on the indemnity basis. The court also ordered the first and second plaintiff pay the defendants’ costs of the defendant’s counterclaim on the indemnity basis, and the plaintiffs pay the defendant’s costs of and incidental to the Final orders on the standard basis.
