The case involved two appeals made by Goldsmith & Tippett against the previous dismissal of their claims against the respondents, AMP Life Ltd and Resolution Life Australasia Limited. The Court of Appeal reviewed the appropriateness and procedural fairness of the decision of Justice Wilson and Justice Crowley. After reviewing the basis of the previous decisions, the contrary positions on the limitation period and procedural fairness, the court dismissed the appeal.
