The matter concerned alleged misleading representations made online by an unknown publisher. The articles were critical of the prospective applicants who wished to bring a proceeding against the publisher of the blog, but did not know the identity of the publisher. The applicants sought discovery of documents relating to the description of the publisher.
The issues concerned whether legal professional privilege applies to a person’s communication of their name to a solicitor whom they wish to engage.
