An application by the plaintiff for an extension to the limitation period for filing a claim for defamation under section 32A of the Limitation of Actions Act 1974 (Qld). The question for the Court was not whether it was reasonable to commence the proceedings outside the one-year limitation period, but rather whether it was not reasonable, in the circumstances, for the plaintiff to have commenced the action within the one-year period.
The proceedings arose from alleged defamatory remarks published on a Facebook page concerning a specialist dog breeder.
