The proceeding involved six separate applications for administrative review of decisions made by the QBCC concerning renovation works undertaken by the applicant builder at a residential property in Wynnum.
The tribunal acknowledged its role was to produce the correct and preferable decisions after conducting a fresh hearing on the merits. The tribunal noted that, in doing so, “The tribunal has the advantage of material not available at the time relevant decisions were made”. The proceeding involved matters of considerable complexity, and expert engineering evidence was relied on by both sides. Having considered each of the decisions and the fresh material filed by the parties in the proceeding, the tribunal found in favour of the applicant in respect of the six applications.
