Submitter appeal against an approval of a high rise office tower in Spring Hill. The matter involved a consideration of the weight to be given to a later planning scheme where the development did not comply with the planning scheme in force at the time the development application was lodged. The appeal also involved an assessment of the proposal against benchmarks regarding height, bulk, scale, character and amenity and the weight to be given to ‘relevant matters’ in the exercise of the discretion under the Planning Act 2016 in relation to impact assessable development.
