This was an appeal following Brisbane City Council’s refusal of a development application. The appellant had sought a development permit for reconfiguration of one lot into two lots and a development permit for material change of use and preliminary approval for building work for a dwelling house on a small lot and a dwelling house. The court considered whether the proposed development’s height and rear setbacks complied with assessment benchmarks and whether compliance could be achieved by imposing development conditions.
