A junior joint venture party sought to restrain the senior joint venture party from exercising certain of its rights as manager of the operations of a Queensland coal mine, in particular the right to take steps in consequence of the junior joint venturer’s non-payment of regular cash call notices to fund the operation of the mine.
The application was dismissed.
Shane Doyle QC, Matthew Jones and Mohammud Jaamae Hafeez-Baig appeared for the successful senior joint venture party. They were instructed by Arnold Bloch Leibler.
The judgment is published here.
