This proceeding was an appeal of a judgement compelling the appellant to indemnify the respondent under contracts of insurance. The appellant contended that the trial judge erred in properly construing the contract between the parties.
The Court unanimously held that the appellant failed to establish any ground of appeal to warrant undermining the decision of the primary judge. The appeal was therefore dismissed with costs.
Sophie Gibson (with Simon Couper QC) appeared, instructed by Norton Rose Fulbright, for the appellant.
