The case involves a claim made by Russell, that the Respondents including, S3@Raw Pty Limited, the operator of a Pilates studio, made defamatory statements about her causing serious harm to her reputation. The Respondent sought to dismiss the defamation proceedings brough against him on that the Applicant failed provide valid concern notices and to establish serious harm pursuant to s10A of the Defamation Act 2005 (Vic). The court dismissed the respondent’s application, finding that the applicant had provided valid concern notices, and the seriousness of harm is to be determined at trial.
