Former joint venture partners alleged that their co-venturer, an industrial real estate agent, had caused numerous “secret commissions” to be paid to his associated entities without permission. Matthew Jones KC acted for the agent and his related defendant entities, which successfully resisted every contested claim. Given the significant credit findings made, the case turned on an analysis of the contemporaneous documents, which demonstrated the plaintiffs’ knowledge of and acquiescence to the payments. By separate reasons, indemnity costs were ordered against the plaintiffs for most of the costs of the proceeding.
