The judgment is a cost hearing that followed a personal injury trial where the plaintiff succeeded against both defendants.
The Court applied r 681 of the Uniform Civil Procedure Rules 1999 (Qld), holding that costs follow the event and ordered the second defendant to pay the plaintiff’s costs on the District Court scale under r 697 because the amount recovered was within that jurisdiction. The Court also allowed costs for two counsels under r 702(2), citing the complexity, length of trial, and volume of material, and ordered the second defendant to pay the plaintiff’s costs incurred in pursuing the first defendant, as its litigation stance necessitated that course.
