Rob Anderson KC represented the respondent, instructed by the Queensland Racing Integrity Commission.
This case concerns the appropriateness of a penalty imposed by the Queensland Racing Integrity Commission (‘QRIC’) on the applicant after he was charged pursuant to rule 141(1) of the Greyhounds Australasia Rules for presenting a greyhound to race that was not free of prohibited substances.
In the original decision, QRIC stewards determined that the appropriate penalty was a 12-month suspension to be suspended for nine months, for a period of 24 months upon no further breach of a similar nature. The applicant applied for internal review of this decision, which upheld the original decision on penalty. Thus, the applicant sought review of this internal review decision in QCAT. Ultimately, the application for review was dismissed and the decision of the internal reviewer was confirmed.
