This was an application for a stay pending an appeal following judgment in the trial division against the appellants and a related company for recovery of possession by the mortgagee of a property.
Mullins P held the appeal against the order for recovery of possession could not succeed. Mr Marer, as the registered mortgagee, was owed at least some amount secured by the mortgage and was therefore entitled to have recovered possession of the real property.
