An application for leave pursuant to s 118(3) of the District Court of Queensland Act 1967 to appeal the orders of Judge Porter KC dismissing an appeal from a defamation trial in the Magistrates Court. The issue concerned principally the defence of honest opinion and whether the Judge in the District Court had failed to characterise the publication as an expression of opinion, rather than a statement of fact.
