The plaintiff claimed $3,000,000 for loss and injury suffered as a result of professional misconduct within the meaning of ss 419 and 420 of the Legal Profession Act 2007 (Qld). The defendants sought orders for the summary dismissal of the proceeding under r 293 of the Uniform Civil Procedure Rules 1999 (Qld) (UCPR); or alternatively, striking out the statement of claim under r 171 of the UCPR. It was held that the plaintiff’s claim is misconceived as a matter of law, and as such, the proceeding is dismissed under r 293 of the UCPR.
