Damian Clothier QC and Stewart Webster successfully represented GVK/Hancock in two related judicial review applications brought by Coast and Country Association of Queensland.
Coast and Country Association of Queensland challenged recommendations made by the Land Court to State Ministers, and challenged the decision of the Minster under the Environmental Protection Act to grant an environmental authority in relation to the proposed Alpha coal mine.
The case involved determinations about the powers of the Land Court, the “finality” principle relating to administrative decisions and causal issues relating to climate change and the burning of coal.
